Betschwar & Co Pty Ltd (“Betschwar & Co”, “we”, “us” or “our”) is committed to protecting your privacy and handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This Privacy Policy explains how we collect, use, disclose, store and protect personal information obtained through our website betschwarandco.com.au, as well as information collected by our agents in person, including at open homes, private inspections, auctions, meetings and other real estate-related interactions.

1. What is Personal Information?

Personal information is any information about you that identifies you, or information by which your identity can be reasonably determined, as well as information recording Betschwar & Co’s dealings with you.

Examples of personal information are your name, address, email address, telephone/mobile number, property details and preferences, inspection attendance records, and any other information provided by you to Betschwar & Co.

We collect personal information in a number of ways, including:

a) Through our Website
When you:

  • Submit an enquiry or contact form
  • Subscribe to communications
  • Interact with cookies or analytics tools

b) In Person
When you:

  • Sign in at open homes, auctions or private inspections
  • Meet with our agents
  • Communicate with us by phone, email or face-to-face

c) From Third Parties

  • CRM, marketing and administrative service providers (such as digital signing and transaction platforms)
  • AML/CTF Service Providers
  • Buyers’ agents

4. Open Homes & Inspection Sign-In

For security, safety and compliance reasons, Betschwar & Co requires all attendees to provide basic personal information before being permitted to inspect a property.

At a minimum, this includes:

  • Full name
  • Contact phone number

This information is digitally collected at open homes, private inspections and other property viewings.

The information is used to:

  • Support the safety and security of owners, occupants, clients and staff
  • Maintain accurate attendance records
  • Assist with follow-up enquiries and relevant communications
  • Comply with professional and regulatory obligations

Providing this information is a condition of entry to inspect a property.
If an attendee chooses not to provide the required details, access to the property may be refused.

Any additional information provided is voluntary unless required by law.

5. Marketing Communications

We may use your personal information to contact you about:

  • Properties you have enquired about
  • Appraisals you have requested
  • Similar properties or opportunities
  • Market updates and insights
  • Agency news and services

If you provide us with personal information about another person (for example, a joint owner, family member, or co-purchaser), you confirm that you have their permission to do so and that they are aware of this Privacy Policy.

We will handle that personal information in accordance with this Privacy Policy.

8. Third-Party Platforms and Inspection Technology

We may collect personal information using third-party platforms and inspection technologies, including property portals, AML/CTF service providers, and CRM systems, such as realestate.com.au and Domain.

Where personal information is collected through these platforms:

  • The third-party provider may also collect, store and use that information in accordance with their own privacy policies and terms of use.
  • Betschwar & Co receives and uses that information in accordance with this Privacy Policy.

We encourage individuals to review the privacy policies of any third-party platforms used to understand how their information is handled by those providers.

9. AML/CTF

In this clause, AML/CTF Laws means Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and Anti-Money Laundering And Counter-Terrorism Financing Rules 2025 (Cth) as amended or replaced from time to time.

You acknowledge and agree that:

  • We are subject to strict obligations under the AML/CTF Laws and must undertake customer due diligence, ongoing monitoring and verification of your identity and related matters prior to providing services to you.
  • You must promptly provide all information and documentation reasonably required by us to comply with AML/CTF Laws including, without limitation, information relating to identity and source of funds.
  • We may, at our absolute discretion and without liability, refuse to act, delay acting, or immediately cease acting on your behalf if:
    – you fail or refuse to provide requested information or documentation; or
    – We are unable to satisfactorily complete AML/CTF verification checks or ongoing due diligence; or
    – We reasonably consider that acting on your behalf may expose us to a breach of AML/CTF Laws.

You acknowledge and agree that:

  • We may collect, use, store, record and otherwise handle your personal information for the purposes of complying with the AML/CTF Laws and associated regulatory obligations.
  • You expressly consent to us disclosing such information to third parties (including, but not limited to, identify verification service providers, financial institutions, regulators, law enforcement agencies, advisors) where reasonably required for AML/CTF compliance or verification purposes, whether located within or outside Australia.
  • We may retain all information and documentation obtained in connection with AML/CTF compliance for the minimum period required under the AML/CTF Laws and, where reasonably necessary to manage regulatory risk, for a longer period as determined by us.
  • We will handle personal information in accordance with applicable privacy laws, including the Privacy Act 1988 (Cth). However, nothing in this Privacy Policy limits our ability to comply with AML/CTF Laws or any lawful request or requirement of a regulatory authority.

10. Overseas Disclosure

We do not actively share your personal information overseas.

Some service providers we use may store data outside Australia as part of their cloud infrastructure. Where this occurs, we take reasonable steps, appropriate to the nature of our business, to ensure those providers handle personal information in a manner consistent with the Privacy Act 1988. 

11. Data Security

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, or disclosure by limiting access.

We implement a range of technical, administrative, personnel and physical measures to safeguard your personal information, including:

  • two-step verifications;
  • individual logins for staff;
  • unique passwords;
  • electronic and physical access restrictions to files containing personal information; and
  • security software

However, no security measures are perfect or impenetrable.

12. Access and Correction

You may request access to, or correction of, the personal information we hold about you by contacting us. We will respond within a reasonable time and in accordance with the Privacy Act.

13. Cookies & Website Analytics

Our website may use cookies and analytics tools to collect non-identifying information such as pages visited, session duration and browser type. This information helps us improve website performance and user experience.
